Review Court Ruling
TALLAHASSEE - The Florida Supreme Court today issued its decision
in the Richard Gwong petition relating to certain inmates in Florida being
denied eligibility for gain-time. The decision denies the right of the
Florida Department of Corrections to promulgate a rule that eliminated
approximately 20,000 inmates from earning gain-time.
The court decision is currently being reviewed by the Florida Department
of Corrections legal bureau, and in conjunction with the Office of the
Attorney General, will determine whether any additional legal action should
be initiated.
The department will review each case initially impacted by the denial
of gain-time and establish a new release date for those who would have
been able to earn gain-time between April 21, 1996, the effective date
of the rule change, and today.
