Department of Corrections Statement on
the Special Session of the Legislature

TALLAHASSEE - The Department of Corrections is awaiting the outcome of the legislative special session in January before proceeding to implement any method of execution other than electrocution.

DOC does not have a plan, protocol or proposal to carry out the death penalty other than by electrocution. DOC officials, under the previous administration, have observed executions by lethal injection in other states. However, no plans were developed in Florida as a result of those observations.

We are confident the electric chair has functioned properly in previous executions and will function properly if used again. We are also prepared to develop a plan to enforce whatever law is passed by the Legislature that specifies a method of execution other than electrocution. Any such plan will be devised in full consultation and with the approval of the Governor's Office, but only after a different method of execution becomes law.
